CMC statement regarding Palm Island death in custody

The Crime and Misconduct Commission has been fully briefed by the Director of Public Prosecutions (DPP) about the reasons behind her decision not to proceed with charges against police officer Chris Hurley, following the death in custody of an Aboriginal man on Palm Island.

The CMC has carefully considered the DPP’s conclusions and the evidence that would be admissible in any disciplinary proceedings.

The Commission has determined that the evidence would not be capable of proving before any disciplinary tribunal that Senior Sergeant Hurley was responsible for Mulrunji’s death.

Therefore, the Commission has reached the inevitable conclusion that no disciplinary action before the Misconduct Tribunal or by the Queensland Police Service (QPS) can be taken against the police officer in relation to the cause of death or in relation to the charges of assault or perjury mentioned in the DPP’s media statement today.

Any other disciplinary charges against Senior Sergeant Hurley arising from the Coronial Inquest are now the responsibility of the QPS.

Dear Cousins,
my sister and I here in Bundjalung country are both doing what we can for our relatives on Palm -- our own Rainbow grew up on that Island, and when we were up in her country, we heard many stories from her and her relatives about the place and the people... the fact that even our most right wing newspaper The (un)Australian has damned the decision for no action against the police shows that this issue is far from over.

what is said of this country and what IS in this country are quite different things, and we are perhaps stronger and more able to take action than it may seem. this kind of business goes on, we all know it, and it is time to shine the light in those dark places.

it would help if anyone felt up to writing to the Australian consulate in their country expressing solidarity. we are also going to make complaints to the Un of course.
